Who we are

This website, thewalnutcreek.ca, is operated by UB Realty Inc., Brokerage ("UB Realty", "we", "us"), a real estate brokerage in Ontario. We are independent Realtors. We do not represent the builder, Acorn Developments. Jolly Deol, Broker of Record, is responsible for our compliance with this policy.

Information we collect

Information you give us

• Registration form: first and last name, email, phone number, the type of unit and budget you are interested in, whether you are a real estate agent (and your brokerage, if so) and any message you send.
• Worksheet: the information above plus your purchase purpose, home choices, address, date of birth, Canadian residency, driver's licence number and expiry, occupation, employer and copies of two government-issued photo IDs.
• Booking a call: the details you enter in our Calendly scheduler.
• Calls, texts and emails you exchange with us.

Information collected automatically

When you visit the site we use cookies and similar technologies from Google Analytics, Google Tag Manager and Google Ads to understand how the site is used and to measure the results of our advertising, for example whether a visit from an ad led to a registration. This can include your IP address, device and browser type, pages viewed, the referring website and ad click identifiers. We do not use this information to identify you personally.

How we use your information

• To send you the pricing, floor plans, deposit details and launch information you request for Walnut Creek.
• To contact you about your enquiry, book appointments and help you choose and secure a home.
• To prepare your worksheet and submit it to the builder for unit allocation, with your knowledge.
• To send you emails, texts or calls about Walnut Creek and similar new homes, only where you have given consent.
• To measure and improve our website and advertising.
• To meet our legal and regulatory obligations as a real estate brokerage, including identity verification requirements.

Consent and marketing messages

We ask for your express consent before sending you commercial electronic messages, as required by Canada's Anti-Spam Legislation (CASL). You can withdraw consent at any time by using the unsubscribe link in any email, replying STOP to a text message or contacting us using the details below. Withdrawing consent does not affect messages we need to send to complete a transaction you have started.

How we share your information

We do not sell your personal information. We share it only as needed with:

• The builder (Acorn Developments) and its sales team, when you submit a worksheet or proceed with a purchase.
• Service providers who help us operate: our customer relationship management system (Follow Up Boss), our website host, email providers, Calendly for scheduling, and Google for analytics and advertising measurement. They may only use your information to provide services to us.
• Lawyers, lenders and other parties involved in your purchase, at your direction.
• Regulators or authorities where the law requires it.

Some of these providers store information outside Canada, including in the United States, where it may be accessible to authorities under local law.

Identification documents

ID copies submitted with a worksheet are not stored on this website. They are sent privately to our team by email, used only to prepare and submit your worksheet and meet identity verification requirements, and deleted once no longer needed.

How long we keep information

We keep personal information only as long as needed for the purposes above and to meet legal and regulatory record-keeping requirements, then delete or anonymize it.

How we protect information

We use reasonable physical, organizational and technical safeguards, including encrypted (HTTPS) connections, restricted account access and limits on who can view worksheets and ID documents. No method of transmission over the internet is completely secure.

Cookies and your choices

You can block or delete cookies in your browser settings, opt out of Google Analytics with Google's browser add-on, and manage ad personalization in your Google account. The site will still work without these cookies.

Your rights

Under Canadian privacy law (PIPEDA) you can ask to see the personal information we hold about you, ask us to correct it, and withdraw your consent, subject to legal and contractual limits. We will respond within 30 days. If you are not satisfied with our response, you can contact the Office of the Privacy Commissioner of Canada.
